METAMATERIAL PIONEER RAYSPAN REJECTS ALL CLAIMS OF INFRINGEMENT BY RUCKUS San Diego, CA. - May 19, 2008 - Rayspan Corporation, the world’s leading innovator of metamaterial air interface solutions, stated today that it would vigorously defend against claims of patent infringement made by Ruckus Wireless in a lawsuit filed May 5, 2008. The lawsuit was filed against Rayspan’s customer, NetGear, in the United States District Court for the Northern District of California and concerns two Ruckus patents. Ruckus included Rayspan in the lawsuit because Rayspan licenses certain metamaterial antenna solutions to NetGear for use in their products, and Ruckus has erroneously concluded that these solutions infringe their patents. Rayspan and its outside counsel have made a thorough analysis of the two Ruckus patents, and on the basis of that analysis we are absolutely confident that Rayspan does not infringe either patent. Rayspan respects the intellectual property rights of others and believes that Ruckus’ action is entirely without merit. Rayspan will vigorously defend this suit. “NetGear is a highly valued licensee of Rayspan technology and in the past has also licensed Ruckus technology. That Ruckus would now find it necessary to sue NetGear is extraordinary and regretful. To me, the actions of Ruckus clearly demonstrate an inability to win and retain the business of a key customer the right way: by delivering high value solutions and maintaining a trusted partnership,” said Franz Birkner, president and CEO of Rayspan Corporation. "We are committed to maximizing the benefits of our technology for our customers and partners while protecting our intellectual property."
